The 2014 Agricultural Law legalized the sale of “nonviable hemp material” grown in states participating in the hemp pilot program, which defined hemp as cannabis containing less than 0.3% THC. The FDA retains the regulatory authority over the CBD from hemp, while the DEA is not involved in the regulation of hemp and hemp products that comply with the law. The Agricultural Act 2018 requires that research and development of the CBD for therapeutic purposes be carried out under notification and reporting to the FDA. In the United States, CBD derived from hemp is legal to sell for industrial purposes or as a cosmetic ingredient, but under FDA regulations it cannot be marketed for medical use or as an ingredient in food, dietary supplements, or animal feed. As of October 2020, cannabidiol extracted from marijuana remains a controlled substance in Appendix I and is not approved as a prescription drug or dietary supplement or is permitted for interstate trade in the United States.
But these two compounds have different properties that separate them. THC is associated with a high feeling or psychoactive effects and CBD is best known for its health benefits. In addition, each has unique and similar effects and benefits that are usually sought for different therapeutic purposes.
